COMPETITION TERMS & CONDITIONS

The promoters are Immediate Media Company London and BMW UK Ltd.

The BBC Code of Conduct for competitions can be found at http://www.bbc.co.uk/competitioncode/ and all BBC magazines comply with the Code.

The promotion is open to all residents of the UK, including the Channel Islands, aged 25 years or older, except the Promoters’ employees or contractors and anyone connected with the promotion or their direct family members.

The closing date for entries is 23:59 on 29th January 2013.

By entering the promotion, the participants agree:

(a) to be bound by these terms and conditions;
(b) that their surname and county of residence may be released if they win a prize; and
(c) that should they win the promotion, their name and likeness may be used by the Promoter for pre-arranged promotional purposes.

Entries can be submitted through the promoter’s website at http://www.topgear.com/bmwcomp.

Entrants should enter by 23:59 on 29th January 2013. Entries received after the closing date of the promotion will not be considered.

Entrants must supply to BBCM their full name, email address and daytime telephone number. The Promoter will use entrants’ personal details in accordance with the Immediate Privacy Policy (http://www.immediatemedia.co.uk/privacy-policy/).

BMW does not accept responsibility for any entries which are lost, delayed, incomplete or otherwise not received or cannot be entered for technical or any other reason. Proof of delivery of the entry is not proof of receipt. Incomplete or illegible entries or those not in accordance with the entry instructions and these terms and conditions are invalid.

Only one entry will be permitted per person, regardless of method of entry. Bulk entries made by third parties will not be permitted.

The winning entrant will be the first correct entry drawn at random from all the correct entries after the closing date. The Promoter’s decision as to the winner is final and no correspondence relating to the promotion will be entered. The winner will be notified within 3 days of the close of the promotion by telephone or email.

The prize may be withdrawn from the said winner and a new winner drawn if the prize is not accepted within 3 days of notification.

The prize for the winner will be a fully insured BMW 320d Touring for 30 days. Redemption of the BMW vehicle will be required on a specific date to be confirmed by the promoter.

The promoter does not guarantee that the winner’s preference BMW model can be met. BMW will decide which BMW 320d will be delivered to the winner. This decision will be final. Should BMW deem the loan car to have been mistreated in any way then all future loans as part of the prize will be null and void, and the competition prize arrangement will be terminated with immediate effect. The loan car will have a mileage limit of 1,000 miles for the entire period of 30 days. The vehicle can only be used for journeys within mainland United Kingdom.

The winner must have a valid driving license and must provide the driving license at the time of the handover.

The BMW motor vehicle will be provided on a loan basis. The loan of the BMW motor vehicle is subject to a separate loan agreement and the BMW Loan Car Terms. The winner must agree to these terms before taking possession of the vehicle. Key Loan Car Terms excerpt: the car may only be driven by the winner, only for private use excluding commuting and travelling sales and not for any form of racing; the winner is responsible for any fines, congestion or other charges arising from use of the car and for any damage arising from his failure to take reasonable care; the car is insured subject to an insurance excess charge (see Loan Car Terms); insurance does not cover personal belongings. BMW has the right to refuse permission to drive if driving offences/disqualifications have occurred or if BMW otherwise considers driver is unfit to drive. Fuel is not included.

There is no cash alternative and the prize will not be transferable. Prizes must be taken as stated and cannot be deferred. The Promoter reserves the right to substitute the prize with one of the same or greater value.

No entry fee, no purchase necessary.

The name and county of residence of the winner will be available [by sending an SAE to Top Gear Magazine Creative Solutions, Vineyard House, 44 Brook Green, Hammersmith W6 7BT] within two months of the closing date of the promotion.

The winner may be required to take part in publicity resulting from this draw without entitlement to any financial reward.

The Promoter reserves the right to amend these terms and conditions or to cancel, alter or amend the promotion at any stage, if deemed necessary in its opinion, or if circumstances arise outside of its control.

The promoter reserves the right to substitute prizes of equal or greater value should circumstances make this necessary.

The promoter’s decision in respect of all matters to do with the promotion will be final and no correspondence will be entered into. Entry implies acceptance of these rules.

The Promoter does not accept any responsibility for lost, delayed or fraudulent entries. The Promoter excludes liability to the full extent permitted by law for any loss, damage or injury occurring to the participant arising from his or her entry into the promotion or occurring to the winner(s) arising from his or her acceptance of a prize.

The promotion is subject to the laws of England.

The promoter’s decision in respect of all matters to do with the promotion will be final and no correspondence will be entered into. Entry implies acceptance of these rules.
